SMS, Automated/Robo Voice Call, and Email Notifications Terms and Conditions
Cobb EMC provides subscription-based messaging in the form of Short Message Service or text messaging, herein referred to as “SMS”, Automated/Robo Voice Calls and Emails for billing and outage information. SMS, Automated/Robo Voice Calls and Emails include the delivery of electronic communications to a mobile device owned or used by a customer of Cobb EMC, herein referred to as “Customer.” Cobb EMC may use automated technology to distribute messages to a mobile device directly or through the use of a 3rd party agent. By opting in to Cobb EMC’s SMS and/or Automated/Robo Voice Call and/or Email Notifications, you opt-in to receive notifications regarding your utility account and/or outage information from Cobb EMC.
Registration and Agreement
Customer may enroll themselves in SMS and/or Automated/Robo Voice Calls and/or Email notification programs to receive proactive information from Cobb EMC regarding outages or billing information. Enrollment in messaging is not a contract for service, and Cobb EMC may not deny nor approve service based on a customer decision whether to enroll in notification programs. Cobb EMC may terminate your enrollment in notification programs at any time without consent for any reason they deem necessary.
By using or receiving messaging, you acknowledge that you have read and understand these Terms and Conditions, and that you accept and agree to be bound by these Terms and Conditions.
Your Mobile Telephone Number
You represent that you are the account holder for the mobile telephone number(s) that you provide or that you have the account holder's permission to enter the mobile telephone number(s) that you provide and that you will not initiate messages to the mobile phone of any other person or entity. You agree to maintain accurate, complete, and up-to-date information with Cobb EMC regarding your use of the billing and/or outage notifications, including, without limitation, notifying Cobb EMC in writing immediately if you change, or cease being the regular user of, your mobile telephone number. You agree to indemnify Cobb EMC in full for all claims, expenses, damages, and costs, including reasonable attorneys' fees, related to or caused in whole or in part by your failure to notify Cobb EMC if you change your telephone number, or cease being the regular user of, including, but not limited to, all claims, expenses, damages, and costs related to or arising under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq.
Fees
Cobb EMC does not bill a separate charge for this service; however, message and data rates may apply from your mobile carrier for any messages sent to the Customer or from the Customer to Cobb EMC. Subject to the terms and conditions of your mobile carrier, you may receive SMS and/or Automated/Robo Voice Calls and/or Emails sent to your mobile phone. By providing your consent to participate in this program, you approve any such charges from your mobile carrier. Charges for SMS and/or Automated Voice Calls and/or Emails may appear on your mobile phone bill or be deducted from your prepaid balance. Cobb EMC may send recurring messages and/or calls and/or emails. Message and/or call frequency varies based on account activity. If you have any questions about your text/voice plan or data plan, it is best to contact your wireless provider directly.
Privacy Policy
Cobb EMC is committed to building user trust and confidence by promoting and complying with the use of business practices that help protect the privacy of the customer and their data. Cobb EMC does not share information with 3rd parties regarding the registration, types of notifications, or any other personally identifiable information. Cobb EMC may collect certain information related to the types of notifications sent to Customer, analysis of the receipt of a message, and any other non-personally identifiable information deemed necessary to improve the notification service.
Discontinuation of Service and Help
You agree to notify us immediately of any changes to your registered mobile phone or device including changes to your telephone number. You further agree to cancel enrollment associated with a discontinued phone number immediately. We reserve the right, in our sole discretion, to cancel or suspend any or all of Messaging, in whole or in part, for any or no reason, with or without notice to you.
• To discontinue Billing SMS or Email Notifications
Customer may elect at any time to discontinue their SMS billing alerts by replying ‘STOP’ to 855-949-3524 for each associated mobile number that has been registered. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have unsubscribed. After this, you will no longer receive SMS messages from Cobb EMC for billing alerts. If you want to join again, just sign up by following the instructions on www.cobbemc.com/account and SMS messages for billing alerts will begin again. Customer may receive assistance by calling Cobb EMC directly at 770-429-2100, replying to SMS with the words HELP, or by e-mailing memberservices@cobbemc.com with a description of the request.
Customer may elect at any time to discontinue their Email notifications for billing alerts by updating preferences for billing alerts via the online account management system.
• To discontinue Outage SMS, Automated/Robo Voice Calls or Email Notifications
Customer may elect at any time to discontinue their SMS outage alerts by replying ‘STOP’ to 898-362 for each associated mobile number that has been registered. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have unsubscribed. After this, you will no longer receive SMS messages from Cobb EMC for outage alerts. If you want to join again, just sign up by following the instructions on www.cobbemc.com/outagealerts and SMS messages for outage alerts will begin again.
Customer may elect at any time to discontinue their Automated/Robo Voice Call outage alerts by logging on to the Outage Alerts Preference Center at www.cobbemc.com/sign-outage-alerts with a valid account number.
Customer may elect at any time to discontinue their Email notifications by clicking on the Unsubscribe link at the bottom of the email or by updating preferences for outage alerts via www.cobbemc.com/sign-outage-alerts.

Customer may receive assistance by calling Cobb EMC directly at 770-429-2100, or by e-mailing memberservices@cobbemc.com with a description of the request.
Terms of Use
By enrolling to receive notifications, Customer is responsible for all mobile carrier costs associated with receiving SMS and/or Automated/Robo Voice Calls and/or Emails. Notifications are informational only, and no warranty is provided as a result of enrolling. Cobb EMC will not be responsible for any loss or damage that could result from interception by third parties of any information made available to you via SMS and/or Automated/Robo Voice Calls and/or Emails. Cobb EMC will not guarantee the accuracy, validity, timeliness or completeness of any information or data made available to you for any particular purpose. Carriers and/or Cobb EMC are not liable for delayed or undelivered messages.

Additional Email Terms and Conditions
I agree to receive periodic e-mail and/or electronic messages from Cobb EMC at the e-mail address(es) I provide. I understand that e-mail and/or electronic messages may relay information about my account and that I can opt-out of receiving notifications at any time. I further understand that I am not required to consent to these terms and conditions in order to purchase any property, goods or services. Cobb EMC does not guarantee delivery of notifications and no warranty is provided for undelivered notifications. I agree to notify Cobb EMC immediately in the event that I voluntarily or involuntarily relinquish any e-mail and/or electronic contact identified above. As result of using this service, message and data rates may apply, and I am responsible for paying these fees. I understand that these terms and conditions are subject to change without notice.
